1. Acceptance of Terms

By downloading, installing, or using OptimaApp ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Service Description

OptimaApp is a mobile application providing UK tax and accounting tools including:

• Tax calculators (Income Tax, NI, VAT, Dividend, CGT, Mileage)
• HMRC Making Tax Digital (MTD) integration
• Open Banking transaction synchronisation
• Invoice generation and management
• Document scanning with OCR
• Consultation booking with Optima Creative accountants

3. Not Tax Advice

The App does not constitute professional tax, financial or accounting advice. All calculations, estimates and information are for guidance only. You are responsible for ensuring the accuracy of any data submitted to HMRC or used for financial decisions. Always consult a qualified accountant or tax advisor for official filings and tax planning.

4. Eligibility

• You must be at least 18 years old
• You must be a UK resident or have UK tax obligations
• You must provide accurate and truthful information

5. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorised access
• You must not share your account with others
• You are responsible for all activity under your account

6. Subscription and Payments

• Free tier: Basic features including tax calculators, deadline tracking, and consultation booking
• Premium tier: £19.99/month or £199.00/year, includes all features (OCR, CIS tracker, invoice generator, mileage tracker, and more)
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Cancellation can be done via Google Play Store or Apple App Store subscription management
• No refunds for partial subscription periods

7. Beta Testing

During the beta testing period:

• The App may contain bugs, errors or incomplete features
• Features may be added, modified or removed without notice
• Beta testers may receive Lifetime Premium access as stated on the landing page
• Beta testers agree to provide feedback and report bugs
• The minimum testing period is 14 calendar days as required by Google Play

8. Third-Party Services

The App integrates with third-party services. By using these integrations, you also agree to their respective terms:

• HMRC: Subject to HMRC API terms and UK tax legislation
• TrueLayer: Subject to TrueLayer's terms of service and PSD2 regulations
• Google Cloud: Document AI for OCR processing
• Stripe: Payment processing

We are not responsible for the availability, accuracy or policies of third-party services.

9. Intellectual Property

All intellectual property rights in the App (code, design, content, branding) are owned by Optima Creative Limited and Ultra Commerce LTD. You may not copy, modify, distribute or reverse-engineer any part of the App.

10. Limitation of Liability

• The App is provided "as is" without warranties of any kind
• We are not liable for any losses arising from incorrect tax calculations or submissions
• We are not liable for interruptions in HMRC, bank or other third-party services
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• Nothing in these terms excludes liability for death, personal injury, fraud or any liability that cannot be excluded by law

11. Termination

We may suspend or terminate your account if you breach these terms. You may delete your account at any time through the App. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms.
